TERMS AND CONDITIONS

By booking with us, you are agreeing to the contract below in its entirety. Please read this before reserving any of our trips.

By booking with WAYKI BUS. you agree to comply with all terms and conditions stated below, which are an essential part of this Agreement; and acknowledge that you understand, and will be bound by them. Furthermore, you agree to have read all the necessary information related to your BUS trip before proceeding with the reservation, acknowledging to be familiar with the physical demands of the activities involved, itinerary, and travel style.

1CONTRACT

All reservations are made with the company WAYKI BUS S.A.C (us/we) and the client (you). When booking a bus trip with us, it will be understood that you have accepted these Booking Conditions (which constitute the complete agreement between you and us) and your reservation will be accepted by us on this basis according to Peruvian law (and no other). The services that will be provided are those mentioned in the confirmation invoice of the reservation. At this point, a contract between the company and the client begins to exist.

2DEPOSIT REQUIREMENTS AND FULL PAYMENT

If you are booking with WAYKI BUS, we will request 100% of the total value at booking time time.

3ACCEPTANCE OF FINAL RESERVATION AND PAYMENT

If we accept your reservation, we will issue a confirmation invoice inmediatly. You will receive a contract between us from the date we issue the confirmation invoice.

4TRAVELERS INFORMATION

For WAYKI BUS to confirm and guarantee the arrangements for your travel bus trip, you must provide all the requested details with the payment of your trip. It includes, amongst others, the full name according to passport, date of birth, nationality, passport number, passport picture, pick-up location, WhatsApp number, and email address. Failure to provide the requested details may result in additional charges or non-refundable cancellation of your bus trip.

If you do not provide the requested details, your reservation does not proceed.

 

5YOUR PASS / BUS TICKET

Your ticket is valid for ONE YEAR. This is ONLY ONE WAY (Long Passes To / From Cusco). No 

The shuttle bus ticket is only for one use.

6ACTIVITIES / TOURS INCLUDED

The price of your bus trip with WAYKI BUS includes some TOURS (ONLY LONG PASSES TO / FROM CUSCO). For more information regarding it. Please see the itinerary of the activity in which you are interested.

 

7ACCOMODATION INCLUDED

By booking with us, you will get the benefit of a free night of accommodation in Paracas / Cusco (dormitory); in one of our partner hostels (ONLY LONG PASSES TO / FROM CUSCO). Please inform us in advance when booking which destination you will enjoy this benefit.

Failure to use this benefit is grounds for any refund or discount.

8HOP ON

Enjoy your freedom and the flexibility that our travel system offers you. Come back on board whenever you want (one time per destination), but always let us know 24 hours before the departure of your next bus (6 pm Peruvian time) to our WhatsApp number + 51 932 633 770 so we can reserve a seat for you.

If you do not notify us on time, we will assume that you want to stay longer at that last destination. We recommend you book your next bus in advance, especially during PERUVIAN HOLIDAYS, HOLY WEEK, CHRISTMAS, and NEW YEAR (72 hrs before). Travelers’ responsibilities are to notify the office when their departure day will be.

9HOP OFF / DROP OFF

The bus service is door-to-door. We will leave you at the door of your hostel in destinations such as Arequipa, Puno, and Cusco (all close to the city center).

If you are in a different location, we will drop you off as close to the main square of the respective city. You have to contact us to provide the information of your pick location for your next bus 24 hours (before 6 pm Peruvian time) before the bus leaves.

DO NOT forget that you must provide us with the location of your hostel for the next city before taking the bus 24 hours (before 6 pm Peruvian time) before the bus leaves.

VERY IMPORTANT:

In places like Paracas, Huacachina, and Nasca they will drop you off at our MEETING POINTS. We decided to do this because these places are small and everything is very close. If you can’t find your hostel, your Wayki guide will help you find it.

  • Nazca (MOM’S CAFE) in front of the Cruz del Sur private bus station.

10PICK UP

Check your pick-up schedule and get ready at your hotel/meeting, because we can arrive at any time. If we delay, we will contact you. Notify us always when and where the pick up will be 24 hrs before bus departure. Before (6 pm Peruvian time)

11MISSING / NOT DOING THE INCLUDED ACTIVITIES

If you decided not to participate in any tour included in your bus ticket or extra activity that you have reserved, you have know that NO refund applies.

If you did not arrive on time for the tour and you lost it, you should know that NO refund applies

All the activities / tours included, have be coordinated with your guide or office +51 932 633 770 at the time of your arrival at the respective destination or before your departure. Not coordinating previously or missing the day of the activity will incur in the loss of it.

13OFFICE TIME

Our door-to-door service has a customer service team. This consists of a schedule defined according to the needs required by the traveler. Please keep the following schedules in mind when requesting assistance.

  • Pick up and drop off: 04:30 am – 21:30pm
  • Your next bus/cancellations: 09:00 am – 18:00pm
  • Book tours at local prices: 09:00 – 18:00pm
  • Hostel reservation: 09:00 am – 14:00pm

Any matter required outside of these times will be attended to the next day. We regret that we cannot help you during non-stipulated hours. We hope you understand.

14TOURS & TOUR OPERATORS

Those are NOT our tours /activities. Wayki Bus works with the best companies and always strives to provide excellent performance regarding the services agreed upon with local suppliers, who are checked and accredited. We have a contract with a network of companies, agencies, operators, and individuals to help carry out our bus trips and tours.

VERY IMPORTANT and annoying for us too, tour operators don’t wait for you as we do and you will lose the tour without any refund if you are late, no show or cancel a few hours before the tour starts.

We recommend you always do it 24 hours before it starts (6 pm Peruvian time)

15CUSTOMER’S RESPONSIBILITY

Applicable on bus trips or activities included with WAYKI BUS SAC.

You assume the responsibility to provide correct and accurate information that is requested by the company. This includes the customer information form that all customers must complete at booking time before their BUS TRIP.

Wayki Bus Company will not accept responsibility for any problem or additional cost that arises from any wrong information provided by you.

You understand and assume possible risks inherent in adventure tours, or other activities of this type and therefore you are responsible for any incidents or other events that may arise in the realization of these.

 

16CUSTOMERS BEHAVIOR

Wayki Bus reserves the right to cancel the ticket of any traveler without any refund if there is any:

  • Improper misbehavior that affects other travelers
  • The consumption of alcohol on the bus (If people agree. We do not have any issues)
  • Smoking cigarettes ON BOARD
  • Sexual harassment of any person traveling with us.
  • Any damage, or lost objects caused by you concerning other travel companions, accommodation, restaurants, etc.
  • Drugs used during the bus ride
  • Carry any illegal drugs or narcotics on any of our bus trips.
  • Illegal act that threatens the group’s health, safety, or well-being

VERY IMPORTANT

If the police or responsible entity finds illegal drugs in your possession (bag /personal belongings), WAYKI BUS will not be responsible. You will be responsible and will assume full responsibility for the consequences of transporting illegal drugs in a foreign country.

17LOCAL GUIDE

Our group trips are guided by a representative of the company WG (Wayki guide / local expert), who will act as your group leader. The decisions made by the group leader are final in all matters that may affect the safety or well-being of any traveler or staff member who participates in the bus trip.

You agree to comply with the decisions made by the group leader and agree not to interfere with the group’s welfare or mobility whilst traveling with the company, otherwise, the group leader may indicate that you leave the bus trip immediately, without the right to reimbursement. When a customer is excluded, the Company will have no further liability to them (including return travel arrangements) and we will not cover any expense or cost incurred as a result of the exclusion.

18CANCELLATION POLICY

*NO SHOWS & CANCELLATIONS: If you cancel a day before the bus at 6:00 pm (Peru time), a 20% administration fee will apply. After this time, there’s a 100% no-show & cancellation fee.

*USED TICKET: If you used part of the ticket. We will proceed to cancel our service, making the respective refund according to the use of services made up to the requested moment in which the client decided not to continue with us, of course in this case, an administrative penalty of 20% of the total amount ticket will be applied. Cancellation is accepted before 48hrs before the bus leaves. 6:00 pm (Peru time)

*CHANGES: Any changes to the Bus ticket date MUST be done 24hrs before the bus leaves. (6 pm Peruvian time)

We can provide a letter for your insurance.

You will receive your money in 20 working days.

Very Important: An administrative expense will be applied to this operation that our part is excepted. This may vary depending on the means we use (Paypal / Money Gram / Western Union / Bank Transfer).

19OUR CANCELLATION

We guarantee that our trips will depart once they have a fully paid traveler. There is no minimum group size and we will not cancel the itinerary. We may cancel a trip, BUS TRIP, OR TOUR at any time before departure if unavoidable/extraordinary circumstances occur (natural disasters such as earthquakes, floods, bad weather, war, political instability such as strikes, or outbreak of diseases that may cause risk to the health), or for any reason, that means that it is not feasible for us to operate the planned itinerary.

If we cancel your BUS / TOUR, you can transfer the amount paid to an alternative departure date or get a refund of your money. If I use part of the service, then the amount generated up to the moment of the suspension of the service will be deducted.

You will receive your money in 20 working days.

Very Important: An administrative expense will be applied to this operation that our part is excepted. This may vary depending on the means we use (Paypal / Money Gram / Western Union / Bank Transfer).

If we have to cancel, we will let you know as soon as possible.

The Company reserves the right to change the itinerary of the trip due to the causes mentioned above, local circumstances, or events beyond our control. In such emergency circumstances, you will cover the additional cost of any necessary changes to the itinerary.

20NO SHOW / MISSING THE BUS

It’s a pity to say it, but failure to show up during the pick-up time will result in the loss of the ticket to its destination. We will leave if you are not there at the indicated time. We always recommend being on time 15 minutes before the bus departure.

*Long Pass: You can reach the bus on your own to the next destination and continue with our service. This expense will be covered by you.

*Shuttle bus: Lost ticket.

We have two meeting points, in Miraflores (Calle Porta 145) or Barranco (Av San Martin 143) where all travelers must be 15 minutes before the bus departure. Unfortunately, we cannot wait for you as we have many passengers waiting for this bus at the next destination. We must arrive on time to be able to continue with them.

Take your precautions. Arrive on time!!

21MODIFICATION / TRANSFER POLICY OF THE TRIP BY THE PASSENGER

If you want to modify or transfer your booking to a third party, you can do so free of charge, this refers to the organization of the bus by us; as long as you follow these requirements of the person who will take your place (passport details, pickup location, departure day, email address, WhatsApp number and passport photo). We request that the reservation holder make this modification via email 48 hours before the departure date or before 6:00 p.m. (Peru time), after that; An administration fee of 15% per person will apply.

Notification of modifications must be made in writing to reservas@waykibus.com. For any emergency, please contact us at this number +51 932 633 770. We will always be happy to help you.

22CLAIMS AND COMPLAINTS

If you wish to make a complaint or raise an issue with your trip, please first contact your guide about your concern. If your issue is not resolved, please email contact@waykibus.com as soon as possible.

23PHOTOS AND MARKETING

Wayki Bus will be taking photos and videos throughout your trip. By signing this document, you give us your full consent to use any photos taken of you and your image for advertising and promotional purposes free of royalties in any medium. If you do not consent to this, email contact@waykibus.com

24FLEXIBILITY

By joining on any of our bus trips, you are accepting that you appreciate and recognize that the nature of this type of trip requires considerable flexibility on your part and must allow for alternative itineraries in the case of unexpected circumstances/events.

The itinerary provided for each bus trip is representative of the types of activities to be undertaken and it is understood that the route, schedules, itineraries, and mode of transportation may be subject to modifications without prior notice due to circumstances or local events outside of our reach (natural disasters such as earthquakes, floods, bad weather, war, political instability such as strikes, and the outbreak of diseases that may cause risk to the health).

25RESPONSIBILITY OF THE COMPANY

Applicable on all bus trips and tours/activities with WAYKI BUS S.A.C.

Wayki Bus will always strive to provide excellent performance on agreed services with local suppliers, who will be verified to be accredited and competent. We contract with a network of companies, agencies, operators, and individuals to help make our trips. We are committed to providing complete and correct information and helping to resolve any questions or concerns about your future bus journey with us. Please note that hygiene, safety, services, and transportation, for example, may vary depending on location. This may be different from what you have experienced in your own country or in others.

Wayki Bus undertakes to help and assist the affected person in the event of suffering any illness or injury (at no expense on our part).

You should be aware that in many of our destinations, hospital or clinic care may not match standards in other parts of the world. This is due to the rugged geography of Peru, which makes access to suppliers difficult and limits resources.

The company is excluded from any liability for any bodily injury, emotional injury, illness, death, or damage (direct or indirect), in connection with your participation in a trip or activity. This includes, but is not limited to: loss (including loss of possessions and loss of enjoyment), additional expenses, costs, or circumstances that may be considered an act of God (actual war or threat of war, riots, civil unrest, terrorist attacks). activity, labor disputes, natural or nuclear disasters, adverse weather conditions, disease, fire, and all similar events beyond our control).

You agree to all that has been read and release us and our officers, employees, agents, and representatives from any liability and expressly waive any claim you may have against us as a result of your participation in an independent trip, tour, or activity assuming the risk with knowledge. We regret that we cannot accept responsibility or pay any compensation in the event of any incident.

26PRIVACY POLICY

Any personal information that Wayki Bus collects about you will be used solely for purposes associated with the operation of your bus trip. The information may be disclosed to our agents, service providers, or other providers to enable us to operate the bus trips and tours.

27TOUR DISCOUNT

You can GET 10 to 15 USD OFF for Trek or tour to Machu Picchu Tours, Amazon Experience with our Partner PERU BUCKET LIST, only if you are a current traveler.

VERY IMPORTANT: The discount is not transferable to third parties. If you don’t use it, you will lose it, they are not cumulative either.

28GROUP DISCOUNTS & MORE

*A group discount of 10 USD OFF per person will be applied to groups of 6 or more traveling together. At least, one of the parties involved will need to send us an email before the bus trip, providing the information of the other members of the group, to verify its authenticity.

*Birthday discounts (10 USD OFF) will be applied to any reservation if the following conditions are met:

  • You book a trip on the day of your birthday
  • Your birthday falls on any day of your trip.

31OPTIONAL ACTIVITIES: BALLESTAS ISLAND

Wayki Bus reserves the right to change the tour of the Ballestas Islands in Paracas if it is affected by bad weather. This tour will be replaced by the tour called “Bahia e isla blanca”, an excellent alternative in this case, where you will be able to appreciate the same species as those of the Ballestas Island.

32LOST & FOUND / DAMEGED STUFF

We Wayki Bus before arriving at every destination ask you always to check your seats and not forget anything. This protocol is followed by all our team members.

We are not responsible for any stuff lost or damaged. We have many travelers jump in – jump off every day.

If we find something. It will go immediately to our section of lost and found items. We will keep these for 30 days. After that, we will donate them to some communities where we work in Cusco as a part of our Social Program.

33ARRIVAL/ DEPARTURES

We, Wayki Bus, try always to arrive on time. Sometimes some issues like the chaotic traffic on the highway, car accidents, highway maintenance, Police inspections, or even rainy weather can cause our arrival delays. If it happens, We will contact you. We ask for your understanding. 

 

34WHATSAPP COMMUNICATION

Wayki Bus carries out all its operations, communication, or sharing of information via WhatsApp. A very fast, simple, and quick way. We invite you to download this application so that communication with you is more precise and faster. This will be very helpful while traveling through Peru.

Our WhatsApp number +51 932 633 770 only answers messages. No calls are responses. It works from 05:30 am – 9:30 pm.

35DAMAGE TO THE BUS

Any damage to the bus (seats, windows, curtains, seat belts, etc.) caused by the traveler. Its replacement or repair will be assumed by the traveler. We strongly request the proper use of the vehicle’s facilities.
